Below is the statement I am prepared to submit for tonight’s BOC meeting regarding the special request for two properties to be rezoned for purposes to utilize them as data centers.

Dear BOC,

The request for a special exception for the data center must adhere to all Spalding County ordinance requirements, as stipulated in the agenda packet. A critical requirement is that the property must not be located within an S-2 water sensitive area.

Evidence obtained from the county via ORR-670-2025—specifically, the S-2 Watershed Protection District Map referenced in Article 21, Section 2104 of the county code—demonstrates that the property is entirely within the designated S-2 water sensitive area.

Conclusion of Non-Compliance:

Since the property is wholly within the S-2 water sensitive area, the request does not comply with the ordinance and should have never been considered by the Board. Non-compliance mandates a variance from the ordinance, an application that was not submitted.

A Call for Accountability:

This request should not have been entertained. It is unacceptable that constituents are forced to spend significant time, especially right before a major holiday, to point out the clear reasons why this item is ineligible for the docket, let alone recommended for approval. We are providing this detailed argument to ensure there is no excuse for overlooking the fact that this request fundamentally violates the rules you yourselves have established.
